Welcome to Darjeeling Walks. These Terms & Conditions (“Terms”) govern your use of this website and any booking made with us. By browsing this website or making a booking, you (“the Guest,” “you”) agree to be bound by these Terms. Please read them carefully before booking.

1. About Us

Darjeeling Walks is a unit of NBTT Travel Solution Private Limited, a company incorporated in India.

References to “we,” “us,” “our,” or “the Company” refer to NBTT Travel Solution Private Limited, operating under the brand Darjeeling Walks.

2. Booking & Confirmation

  • A booking is confirmed only upon receipt of 40% of the total tour cost at the time of booking.
  • The balance 60% is payable no later than 7 days before the date of arrival.
  • We reserve the right to treat a booking as cancelled if the balance payment is not received by the due date.
  • Bookings are accepted subject to availability and our written confirmation (email or other written communication).

3. Payment Methods

We accept payment via:

  • Bank transfer (NEFT/domestic transfer)
  • International wire transfer (SWIFT)
  • Credit/debit cards
  • PayPal
  • Wise Business

All payments must be made in the currency and to the account details specified in your booking confirmation. Any bank charges, conversion fees, or transaction charges are the responsibility of the Guest.

4. Eligibility & Minors

  • The minimum age for an independent traveller booking and travelling alone is 18 years.
  • Travellers under 18 (“minors”) must be accompanied and supervised at all times by a parent or legal guardian.
  • The accompanying guardian assumes full responsibility for the minor’s safety, conduct, and wellbeing throughout the tour.

5. Group Size

There is no fixed minimum or maximum group size for our tours unless otherwise specified for a particular itinerary.

6. Cancellation & Refund Policy

Cancellations must be communicated to us in writing (email or WhatsApp message to our official contact numbers/email).

This policy applies regardless of the reason for cancellation, except as set out in Section 9 (Force Majeure), where additional costs — not refunds — are addressed separately.

7. Itinerary Changes

We reserve the right to make reasonable changes to the published itinerary due to weather conditions, road/trail conditions, safety concerns, or operational requirements. We will make every effort to provide a comparable alternative.

Any additional cost arising from a change to the itinerary, for any reason, will be borne by the Guest.

8. Health, Fitness & Trek Participation

  • Several of our treks (including but not limited to Dzongri, Sandakphu, and Green Lake) involve high-altitude trekking and physical exertion.
  • Guests participating in such treks are required to submit a self-declaration of fitness and health prior to the trek.
  • It is the Guest’s responsibility to disclose any pre-existing medical conditions that may affect their participation.
  • We provide trekking equipment where required; however, Guests are welcome to bring their own personal gear.
  • Guests participate in all trekking and outdoor activities at their own risk.

9. Travel & Medical Insurance

Darjeeling Walks does not provide travel, medical, or evacuation insurance. It is the sole responsibility of the Guest to obtain adequate travel insurance — including coverage for medical treatment, emergency evacuation (including helicopter evacuation where applicable for high-altitude treks), trip cancellation, and personal belongings — prior to travel. We strongly recommend doing so, particularly for high-altitude itineraries.

10. Permits & Documentation

  • For tours requiring special permits (such as the Sikkim Inner Line Permit or Protected Area Permit), we arrange the necessary permits on behalf of the Guest, subject to receipt of required documents (passport copy, photographs, visa details, etc.) within the timeline communicated at booking.
  • Foreign nationals are responsible for ensuring they hold a valid passport and the appropriate Indian visa for their travel. Darjeeling Walks does not provide visa guidance or assistance.
  • Failure to provide required documents in time may result in delay, denial of permit, or inability to undertake the affected portion of the tour, for which Darjeeling Walks is not liable.

11. Third-Party Services

Our tours may involve services provided by third parties, including but not limited to hotels, homestays, transport operators, and local vendors. While we select these partners carefully, Darjeeling Walks is not liable for the acts, omissions, service quality, or any loss or damage caused by third-party service providers. Any disputes regarding such services should be raised promptly with us so we may assist, but the ultimate responsibility for that service rests with the third party.

12. Force Majeure

Darjeeling Walks shall not be held liable for any failure or delay in performance of its obligations arising from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, landslides, road closures, political or social disturbances, strikes, bandhs, government action, or pandemics.

In the event of itinerary changes or additional costs arising from such circumstances, the additional cost, if any, shall be borne by the Guest.

13. Limitation of Liability

  • The total liability of Darjeeling Walks / NBTT Travel Solution Private Limited, under any circumstance, in connection with a booking, shall be limited to the total amount received from the Guest for that booking.
  • No claim for damages, compensation, or loss exceeding this amount shall be made against the Company.
  • This limitation applies to all claims, whether arising from breach of contract, negligence, or any other cause, to the fullest extent permitted by law.

14. Guest Conduct

We reserve the right to remove any Guest from a tour, without refund, if their conduct is found to be unsafe, disruptive, or in violation of local laws or the reasonable instructions of our guides/staff.

15. Photography & Media

During tours, Darjeeling Walks staff or guides may take photographs or videos of Guests for promotional and marketing purposes (including the website, social media, and brochures). If you do not wish to be photographed or featured, please inform your guide or notify us in writing in advance.

16. Intellectual Property

All content on this website — including text, images, logos, and itineraries — is the property of NBTT Travel Solution Private Limited / Darjeeling Walks and may not be reproduced or used without prior written permission.

17. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or any booking shall be subject to the exclusive jurisdiction of the courts at Siliguri (Sub-Divisional Court), West Bengal, India.

18. Changes to These Terms

We reserve the right to update or modify these Terms at any time without prior notice. The version published on this website at the time of booking shall apply.
